The saidfirstparty hereby covenants and agrees to convey the said premises to the said second party by a good and sufficient warranty deed, executed by the first party, which shall be delivered to the second party upon payment being made as provided herein. ;< Thefirstparty agrees to furnish to the second party a complete merchantable abstract of 'title to said premises, brought down to the date of said deed, showing a merchantable title to the said premises, free and clear of any and all encumbrances, in the person making said deed. The taxes of said premises for the year 1923 are to be paid by the second party. On its part, the second party agrees to pay the said sum of Thirteen Thousand, Six Hundred and Five Dollars ($13,605.00) in the following manner, to wit: #13,605.00 less $3708.00 due on contract between C. W . Mitchell dated January 5. 1920. It is mutually agreed by and between the parties hereto that the covenants and agreements herein contained shall extend to and be obligatory upon the heirs, executors, administrators, and assigns of the first party arid the successor of the second party. I N W I T N E S S W H E R E O F , Thefirstparty has hereunto set his hand and seal, and the second party the signature of its-authorized officer and its corporate seal. E v a n s , this recommendation w a s approved. 2. That the following agreement cancelling agreement entered into with W . W . Mitchell by the University through the Comptroller and Superintendent of Business Operations under date of November 3, 1923, set forth below in letter of that date from W . W . Mitchell be approved and entered into by the Board. IT IS H E R E B Y M U T U A L L Y A G R E E D by and between W . W . Mitchell of the County of Montgomery and State of Illinois, and the Board of Trustees of the University of Illinois, Urbana, Illinois, hereinafter called the University, that upon payment by the University of the rent due under an agreement, the terms of which are stated in a letter dated November 3, 1923, from W . W . Mitchell to James M . White, copy of which is attached hereto, marked Exhibit "A" and forming a part of this agreement, to the date of the acceptance by the University of an assignment by W . W . Mitchell of the sale contract dated January 5, 1920, which the said W . W . Mitchell holds from C. W . Walcott for the purchase of Lot twenty (20) in Forestry Heights Addition to Urbana, Illinois, situated in the County of Champaign and State of Illinois, and also known as 1117 Nevada Street, Urbana, Illinois, that upon the said date of acceptance of the assignment of said sale contract, the lease agreement hereto attached and marked Exhibit "A" shall be terminated. Dated at Urbana, Illinois, this 7th day of January A. D. 1924.
